The law protects the relationship between a client and a licensed mental health provider. Generally, your information cannot be disclosed without written permission and is protected by HIPPA laws/regulations. However, there are some exceptions which would require us to disclose your information:
- If there is suspected child abuse, or dependant adult, or elder abuse the clinician is required to report this to the appropriate authorities.
- If a client is threatening serious bodily harm or death to another person the clinician is required to notify the police.
If a client has imminent intent to commit suicide, or to harm himself/herself, the clinician will have to notify the police and/or emergency services.
- Also, please be aware that a judge can demand your clinical records by subpoena. In this situation we will notify you but we will have to produce the records to the court as ordered.
